                 NOTIFICATION

 

 

PHA, FAISALABAD REGULATIONS FOR OUTDOOR ADVERTISEMENT, 2015.

In exercise of the powers conferred under section 31 of The Parks and Horticulture Authority Act XLVII OF 2012, the Board of Directors of Parks and Horticulture Authority Faisalabad is pleased to frame its regulations for Outdoor Advertisement.

 

  1. SHORT TITLE, EXTENT AND COMMENCEMENT.

 

  1. These regulations may be cited as PHA Faisalabad Regulations for Outdoor advertisement, 2015.

 

  1. These regulations shall extend to the operational area of the Parks and Horticulture Authority, Faisalabad.

 

  • These regulations shall come into force with effect from 01.07.2015. However, these regulations shall come into force with immediate effect to the extent of new registration of advertisers and issuance of new NOC for installation of boards etc.

 

PART- 1

  1. DEFINITIONS

 

Unless otherwise expressly stated, the following terms shall, for the purpose of these Regulations have the meanings indicated in this part. Where the terms are not defined they shall have their ordinarily accepted meaning or such as the context may apply.

  1. “ACT” means The Parks and Horticulture Authority Act 2012.
  2. “ADVERTISEMENT” means commercially displayed or installed signage, board, screen, streamer, poster, banner or any other thing placed, painted, pasted or installed on public or private property that is visible from a public place and is intended to inform the reader of the availability of a service, product or promotes a business.
  • “ADVERTISING SUBSTANCE” means, any one or more of the following :- Corrugated, Trivisions, Neon signs, MMT signs, Hoardings, Billboards, Pole signs, Sky Signs, Name Boards, Notice Boards, Indicating boards, Banners, Streamers, moppy signs, LED , Posters, Skin, Leaflet, any type of advertisement a one way vision, Stickers, temporary publicity stalls, any vehicle including bus, truck, float, tractor, trolley, rehra, cart, tonga, cycle, auto rikshaw, taxi, car, jeep, boat or any other movable vehicle or through balloon / aeroplane etc.
  1. “ADVERTSMENT ON MOVING VEHICLES” any type of advertisement, which is made on moving vehicles such as bus, truck, tractor, trolley, floats, cycle, auto rickshaw, taxi, tonga, rhea, cart, boat or through air / aeroplane etc.
  2. “AUCTION” means to lease out outdoor advertisement of any nature through open competitive bidding after such period as may be prescribed by the Authority to ensure transparency and fairness.
  3. “AUTHORITY” means the Parks and Horticulture Authority, Faisalabad established under section 3 (2) of Parks & Horticulture Authority Act-2012
  • “BILL BOARD / HOARDING” includes an advertisement fixed, placed or displayed on a structure other than a building.
  • BUILDING ELEVATION” is a view of a building seen from one side, a flat representation of one facade.
  1. “CHAIRMAN” means the Chairman of the Authority.
  2. “COMMISSIONER” means the Commissioner of the Faisalabad Division appointed under the Punjab Land Revenue Act 1967.
  3. “COMMERCIAL BUILDING” means, a building having shops or show room, offices, hotels, restaurants, etc. on any floor and may also have apartments in it.
  • “COMPETENT AUTHORITY” means, the person or Committee so authorized by the Director General to take cognizance of matters covered in these Regulations.
  • “DIRCTOR GENERAL” means, the Director General of the Authority.
  • “DIRECTIONAL SIGN” any small hoarding fixed for the guidance of general public towards a   commercial or non-commercial entity
  1. “GOVERNMENT” means Government of the Punjab.
  • “KANAL” means a size of land equal to 20 marlas or 500 sq. yard        (418 m2).
  • “LED / LCD” means light emitting diode / liquid crystal display.

xviii.   “MARLA” means a size of land equal to 25 sq. yard or 225 sq. feet           (20.9 m2).

xix.     “MEMBER” means a member of authority and include its chairman.

  1. “MMT SIGNS” means any board made of MMT Sheet / Skin Sheet or     like material.

xxi. “MOPPY SIGN” means a small hoarding to be fixed on green belts,   central medians, near bus stops etc.

xxii “NAME BOARD” means, a board or any other substance used for the purpose of exhibiting the name of the firm or a business or individual or services.

  • “NEON SIGN” means any name board, notice board, indicating board or advertisement, illuminated by electricity or any other mean including an illuminated night sign.
  • “OFF SITE” means any notice board/hoarding/sky board which is installed by registered Architect/Company/ person to let it for advertisement purpose.
  • “ON SITE” means any notice board /hoarding/sky board which is installed for advertisement of its own business purposes of any company etc.
  • “OPERATIONAL AREA” means the four Urban Municipal Towns namely Lyallpur Town, Madina Town, Iqbal Town and Jinnah Town of the District of Faisalabad.
  • “OUTDOOR ADVERTISMENT” means a streamer, board, poster, banner , or any other thing placed, painted, pasted or installed on a public or private building or property so that it is visible from a public place and which is intended to inform the reader of the availability of a service, product or outlet or otherwise promote a person or a message.
  • “PERSON” include an individual, firm, cooperative society or association of individuals whether incorporated or not.
  • means prescribed by these regulations.
  • “POLE SIGN” means any name board, notice board or advertisement board installed / fixed on the electric pole, street light pole, only one approved sign is installed / fixed on the pole. The PHA reserves the right to use remaining portion of the pole for streamer / hanger and collect charges.
  • “POSTERS” any poster for the purpose of advertisement pasted or fixed or placed anywhere on building, wall, tree, any type of poles, fences or on any moving vehicle.
  • “REGISTERED ADVERTISERS” means, person, Multinational /National Companies qualified as such and enrolled on the list of approved advertisers maintained by the authority.
  • “RESIDENTIAL BUILDING” means, a building exclusively designed for use as a human habitation, together with such other houses as are ordinarily ancillary to the main building and used in connection therewith.
  • “SKY SIGN” means a sign installed on a building for its view from a distance.
  • “SKY LINE” means upper line of the building in the area.

 

  • “STREAMER” a vertical banner of wooden frame being fixed on street light poles for a weeks’ time.

 

  • “STRUCTURAL CALCULATIONS” means, detailed calculation showing sufficiency of the strength of every load bearing part of the proposed structure.
    • “STREET FURNITURE” means any structure installed by Government for the purpose other than advertisement that is public toilets, bus stops, bridge panels etc.

xxxix. “TERRITORIAL AREA” means the whole District of Faisalabad

  • “TRIVISION” means, a publicity illuminated/ non-illuminated board made of steel structure having three visions.

 

PART II

  1. APPLICATION OF PHA REGULATIONS

Every prospective advertiser including the Federal and Provincial Government, autonomous, semi autonomous and local bodies of Provincial and Federal Govt., Federal and Provincial Government agencies intending to carry, outdoor advertising within the limits of the operational area of the Authority shall comply with the “PHA REGULATIONS FOR OUTDOOR ADVERTISEMENT 2015” and shall not undertake any job of the kind in PHA’s operational area without prior approval as prescribed.

  1. REGULATION AND CONTROL OF ADVERTISEMENT

No Advertisement shall be erected, exhibited, fixed or retained upon or over and land, building , wall, hoardings, frame, post or structure or place within the operational area of Authority without prior written permission of the Competent Authority, granted in accordance with the provisions of these Regulations.

Provided that no permission shall be required for any onsite Advertisements,  having size less than 200 Sqft, which;

  1. Is exhibited on the glass with a transparent film within the window of any building if the advertisement relates to the trade, profession or business carried in that building provided it does not violate any building Bye-Laws , rules or regulations for the time being in force; or
    1.  Relates to name of the premises for building, trade, profession or business carried on, within the premises or building upon which such advertisement is exhibited; or .
  • Relates to any activity of the Federal, Provincial o any Local Government; or
  1. Is exhibited on an enclosed land and building not visible from outside the land or building.
  2. is a name plate announcing the name of owner or name of occupier of building and/or name of a building upon which such advisement is so fixed, exhibited painted, pasted, retained or displayed.
  3. in the case of residential buildings where commercial activity like nursing home, charted accountant, advocate, doctor, architect or any other professional is running, as permitted by law, and advertisement is allowed up to maximum as permitted under the provisions of respective law in force for the time being.
  4. REGISTRATION OF ADVERTISERS

(1)       Any person intending to erect, exhibit or fix any advertisement or to carry Advertisement job shall get himself registered on the panel of registered advertisers of the Authority, Faisalabad, by submitting an application to the Competent Authority on the prescribed form and on payment of registration fee of Rs. 30,000/- annually along with one time security fee of Rs 50,000/- under the provisions of these Regulations.

(2)        A practicing advertiser shall also get himself registered on the penal of advertisers of the Authority by submitting an application in prescribed form appended to these Regulations.

(3)      An Application referred to in sub-Clause (1) shall be accompanied by;

  1. Attested Copy of CNIC, in case of individual;
  2. Attested Copy of registration Certificate, in case of firm, corporation or Company;
  • NTN number;
  1. No default Certificate/Affidavit;
    1. Indemnity Bond

(4)   The Competent Authority reserves the right to approve or reject any such application subject to criteria at Annexure ( A ) and registration requires renewal in every financial year.

  1. APPLICATION FOR THE PERMISSION OF ADVERTISEMENT.

(1)    Any person intending to erect, exhibit, fix or retain any Advertisement, for which the prior written permission of Competent Authority is required, shall apply for such permission of the Competent Authority by filing an application on a prescribed form and on payment of such fee as may be prescribed from time to time under the provisions of these Regulations.

(2)        An Application referred to in sub-Clause (1) shall be accompanied by;

  1. Written request of landowner or the person legally authorized to accord such NOC.
  2. A full specification showing the dimensions of such sign, its location or proposed location on a building or other supporting structure, the materials of construction, design, and where applicable, the number of electric lights and electrical details in regard thereto;
  • In the case of Hoarding signs, information in regard to all calculations upon which such size is based;
  1. Any other details required by the Competent Authority; and
  2. The paid Original Bank Challan of prescribed NOC/Permission fee for each application before the approval of permission.

 

  1. PROCEDURE ON APPLICATION

       (1)     On receipt of an application under Clause-4, the Competent Authority shall refer it to the Director (Coordination & Marketing) for detailed scrutiny and submission of his recommendations.

(2)    The Director (Coordination & Marketing) while considering an application in terms of sub-Clause (1), must, in addition to any other relevant factor, legislation, policy and byelaws for the time being in force, shall have due regard to the following:

  1. The compatibility of the proposed advertising sign with the environment and with the amenity of the immediate neighborhood, urban design and streetscape;
  2. Whether the proposed advertising sign will;-

 

  1. Have a negative visual impact on any property zoned or used for residential purposes.
  2. Constitute a danger to any person or property or to motorists or pedestrians or obstruct vehicular or pedestrian traffic;
  3. In any way impair the visibility of any Road traffic sign;
  4. Obscure any existing and legally erected advertising sign;
  5. Obscure any feature which in his opinion is of a natural feature, architectural feature or visual line of civic, architectural, historical or heritage significance; or
  6. Be unsightly or objectionable or detrimentally impact on the architectural design of any building on the property concerned or any adjacent property;

 

  1. The number of advertising signs, displayed or to be displayed on the property concerned and on any adjacent property and its visibility in the circumstances in which it will be viewed in compliance with the minimum distances as prescribed.
  2. The area of control applicable to the property on which the proposed advertising sign is to be erected and the immediate surrounding area.
  • Any written representations, objections and comments received from any interested person. Director (C & M) shall decide the objections etc before proceeding with the case; and.
  1. Any conflict with provisions of these Regulations.

(3)          If, upon scrutiny of the application, the Director (Coordination and Marketing) requires any additional information with respect to the application or if the application is incomplete, the Director (C&M) shall inform the person in writing and such information shall be provided to him within a period of seven days from issuance of such notice.

(4)          If the Person fails to furnish the required information within the stipulated time, the application for permission shall stand rejected and fees submitted by him shall be fortified and the security fee may be refunded on his written request.

(5)      After submission of scrutiny report and recommendations by the Director (C & M), the Competent Authority, may grant permission, on such terms and conditions as it may determine, or refuse the application.

(6)    The holder of permission for Advertisement must ensure that, on every Advertisement for which the permission is granted, the unique number of the permission shall be displayed at prominent place.

(7)        The permission granted under sub-Clause 5 shall be valid only for a period of one year and on expiry of such period, every Person shall apply for its renewal and the Competent Authority may grant permission, on such terms and conditions as it may determine, or refuse an application for renewal with or without assigning any reason.

PART-III

8       TYPES OF ADVERTISEMENT AND CRITERIA

  1. Residential Buildings: Installation of advertisement and signboards in or on residential Buildings shall not be permitted except for onsite signage for purpose of   identification on buildings legally allowed for a purpose other than residential.
  2. Commercial/Industrial Areas/Building: The competent authority may allow advertisements and signboards in the commercial/industrial areas / buildings, however, advertisements and signboards on buildings and Roads shall be allowed only if in conformity with the prevailing building regulations and other act, ordinance, rules, regulations, By-Laws or notification issued to protect and preserve the environment, design and architecture or right of way in the area.

 

  • Onsite signage on the business premises shall be encouraged to be standardized and limited to create an ambient and pleasant environment.
  1. Along Roads Declared Commercial: Outdoor advertisement board and signs may be allowed on Roads which have been declared as commercial, but limited to static advertisements (where the frame, structure and message are stationary).
  2. Any kind of moving signs, LCDs or LEDs shall not be permitted along Roadsides .However these may be permitted at pedestrian areas, parking place and in parks and markets.

 

  1. Sky Sign
  2. a) Display of any sign on private, Govt. or any other property is permissible subject to the approval of the authority in accordance with PHA policy & specifications.
  3. b) Façade Sign /Wall Sign: The sky sign can be fixed on the façade of commercial building with the maximum size of 1200 Sft. The advertising structure must be contained completely within the solid boundaries of the building walls (i.e. the sign must not be wider or higher than the building itself). The advertisement must not extend over or block windows or other openings in the building.
  4. c) Roof Top Sky Sign: up to three storeys commercial building is allowed to install roof top sky sign. The board will be installed within parapet wall and maximum height will be 15 feet from roof level including structure. The building having more than three storeys is not allowed to install any type of sky sign on the roof top.

vii)             Bill Board: In case of Bill Board/ Sign Board on land, they should not exceed the height limit of 35 feet. However, along the elevated structure like over head bridge, height limit shall be measured from the top level of the road at the bridge.

PART- IV

                   SIZE, SPACING, STRUCTURE AND SAFETY OF ADVERTISEMENTS

  1. SIZE. – The size of on-site and off-site Advertisements and signboards shall be standardized and notified by the Competent Authority, while considering the special characteristics of each place, market, roads or premises. However, the maximum size of any Bill board shall not exceed  60’ X 20’ in cities and will not exceed  90’ X 30’ on highways and intercity roads.
  2. SPACING. – The minimum spacing between two Advertisements should not be less than 150 feet for bill Boards, hoarding boards or free standing Boards on ground within city and not be less than 200’ on intercity Roads and highways. Only one wall sign /façade sign shall be allowed per building elevation.
  3. STRUCTURE. – Every Person having due permission of Competent Authority to retain, erect, exhibit or fix the Advertisements in any area shall ensure that the Advertisement is aesthetically pleasing and blending with the surrounding architecture, design and environment of the area.
  4. SAFETY.- Every person erecting, exhibiting, fixing or retaining any Advertisement, for which the prior written permission of Competent Authority has been given, shall develop an adequate control and system to ensure;
  5. No advertisement or sign boards, cutouts on temporary basis shall be installed inside central medians, roundabouts and triangles except direction board, moppy signs and publicity material like streamers and pole signs to be fixed on street furniture or poles.
  6. Sign boards site will not be given/renewed to an advertiser, Multinational /National companies who is either defaulter or blacklisted or is in habit of litigation with PHA.
  7. The publicity board will not hinder the view of the drivers for safe driving and is not a hurdle in the free flow of traffic.
  8. Minimum clearance between Road level and the lower edge of the signboard shall be 12 feet ( in case of 20’*60’), 10 feet ( in case of 15’*45’) and 7 feet ( in case of 10’*20’ or 10’*30’).
  9. The installation of Advertising Substance in or on monument building, grave yard, mosque, shrine, churches or other place of worship, or a Govt. building or a place of national importance shall not be allowed.
  10. No cross Road banner will be allowed.
  11. All outdoor advertisement and sign boards shall be fabricated in a structurally safe manner and shall be installed or retained in a manner which doesn’t adversely affect the road safety or integrity of the building structure on which they are fixed. The advertising company / sole proprietor shall be bound to adhere to the instruction / guidelines issued by the Govt. or Authority.
  12. The commercial advertisement must not be placed on heritage buildings, items excluding Railway Station.
  13. No advertisement or sign board shall be affixed to traffic signal or directional board poles.
  14. No advertisement or sign board shall use imitation, images or colors of traffic signals, traffic signs or directional indicators anywhere in the vicinity of road junctions and traffic signals.
  15. Pole sign on street light pole shall be only allowed in accordance with the designed structural stability.
  16. SCRIPT OF ADVERTISEMENT. (1) Every person having due permission of Competent Authority under Clause 9 (5) to erect, exhibit or fix the Advertisements in any area shall ensure that the Advertisement should not be contrary to social norms, public morality and public decency or against the state or any religion or creating ethnic or sectarian conflict considered misleading to the general public.

(2) On receiving such complaints the Competent Authority shall notify a committee, including members from academia and civil society to act as a review forum for addressing public complaints against such offensive matter.

  1. Alterations of and additions to Advertisements:-

(1)    Any person wishing to alter or add to any Advertisement, including any sign board on which it is displayed, shall first apply to the Competent Authority in writing for its approval.

(2)    Any application referred to in sub clause (1) shall in addition to the requirements of these Regulations specify the nature and extent of the proposed alteration or addition.

(3)    Any person intending to apply under sub-Clause (2) for the approval of Competent Authority, shall furnish such additional particulars in connection with his application as the Competent Authority may require.

PART-V

  1. INSPECTION / EXAMINATION/PENALTIES.

The authority may through its authorized officers at any time, before approval of application received and during execution of work, before and after receipt of completion notice and from time to time inspect the installation.

If on making any inspection under the Regulations authority finds that the advertisement substance contravenes any of provisions of these Regulations, the officer duly authorized by the authority shall by written notice require the person (owner) within a period to be specified in such notice, to make such alteration as shall be specified in such notice with the object of bringing advertisement substance in conformity with the approval, specification and policy of PHA.

In the event of default, without further notice the billboard, hoarding, neon sign etc shall be uprooted at the cost & risk of advertiser and the debris and any fees deposited shall be confiscated and fine of Rs.20,000/- may be impsed. More than three instances of violation by an advertiser shall warrant black listing of the advertiser.

  1. 16. APPEAL

Any person aggrieved by an order passed under these Regulations may file an appeal to the Commissioner, Faisalabad within 30 days of the receipt of order.

Any person aggrieved by an order passed by the appellate authority/Commissioner may file an appeal to the Secretary, HUD & PHE. Dept within 60 days of the receipt of order. The decision of the Secretary, HUD & PHE Deptt. shall be final.

  1. SPECIAL POWER
  2. The D.G. may at any time for reason to be recorded in writing direct the removal of any bill board, sign board etc. if in his opinion such bill board, or notice board etc is indecent, obscene or offensive to good taste or space or site is required for other purpose by PHA, Govt. or for public interest.
  3. The Authority may at any time withdraw any of it approval without assigning any reason. However the aggrieved   persons will be paid the balance of lease money proportionately.
  4. The D.G. on behalf of Authority shall use all the powers provided in the PHA ACT 2012.
  5. Maintenance of Advertisements.-
  6. I) The person having possession and control of any Advertisement shall, while such Advertisement is displayed at all times maintain such advertisement, including any signboard on which it is displayed in good repair and safe conditions.
  7. INDEMNITY.
  8. Any person duly authorized to erect, exhibit or install and Advertisement shall indemnify against any loss to life or property arising out of the incident due to collapse of advertisement board/sign to the extent :-

 

In case of death                                              Rs.5 Hundred Thousands

 

In case of Injury                                              Rs.50 Thousands

 

In case of loss to property Rupees/

Compensation                                                 As per site assessment by the credible and practicing Civil Engineer, registered with Pakistan Engineering Council.

  1. AUCTION OF ADVERTISEMENT SITES.
  2. i) All sites for installation of hoarding signs/bill boards (other than moppy signs, directional boards, streamers, banners and floats) on parks /green areas/belts shall be awarded through open auction for a period of three years, extendable for two years in discretion of Director General, in order to gain maximum revenue for the Authority.
  3. ii) The D.G PHA may allow the Multinational or National Companies or both to participate in the auction.

 

 

 

 

  1. Advertisement Fee.
  2. i) The PHA Faisalabad shall in each financial year notify the Advertisement Fee for a fiscal year. The Advertisement Fee may vary from area to area (appended as Annexure ( B ).
  3. ii) The detail of categories of A+, A, B and C Roads and Chowks is appended at Annexure ( C )

iii)        The Board of Directors of PHA may re-categorize any road or chowk at any time.

  1. The Board of Directors of PHA reserves the right to enhance, reduce or change the rates /fee in the public interest.
  2. Collection of the amount of charges/fee shall be made at the Head Office i.e. Coordination and Marketing Directorate of Authority in such manner as the Competent Authority may determine.
    1. The D.G. may in his discretion allow the publicity free of cost, which is purely of a charitable nature or is to be advertised in public interest.

 

  • Provided if required collection of the charges/fees of all items at Annexure (B) shall be made through contractor by awarding collection rights to him for a period not exceeding one financial year and contract of collection rights of charges/fees shall be awarded to contractor in the manner prescribed in Punjab Local Government (Auctioning of Collection Rights) Rules, 2003 mutatis mutandis .

 

  • A Reserve Price Committee will be constituted by the Director General for assessment of reserve price of items collection of which is to be made through contractor.

                 NOTIFICATION

 

 

PHA, FAISALABAD REGULATIONS FOR OUTDOOR ADVERTISEMENT, 2015.

In exercise of the powers conferred under section 31 of The Parks and Horticulture Authority Act XLVII OF 2012, the Board of Directors of Parks and Horticulture Authority Faisalabad is pleased to frame its regulations for Outdoor Advertisement.

 

  1. SHORT TITLE, EXTENT AND COMMENCEMENT.

 

  1. These regulations may be cited as PHA Faisalabad Regulations for Outdoor advertisement, 2015.

 

  1. These regulations shall extend to the operational area of the Parks and Horticulture Authority, Faisalabad.

 

  • These regulations shall come into force with effect from 01.07.2015. However, these regulations shall come into force with immediate effect to the extent of new registration of advertisers and issuance of new NOC for installation of boards etc.

 

PART- 1

  1. DEFINITIONS

 

Unless otherwise expressly stated, the following terms shall, for the purpose of these Regulations have the meanings indicated in this part. Where the terms are not defined they shall have their ordinarily accepted meaning or such as the context may apply.

  1. “ACT” means The Parks and Horticulture Authority Act 2012.
  2. “ADVERTISEMENT” means commercially displayed or installed signage, board, screen, streamer, poster, banner or any other thing placed, painted, pasted or installed on public or private property that is visible from a public place and is intended to inform the reader of the availability of a service, product or promotes a business.
  • “ADVERTISING SUBSTANCE” means, any one or more of the following :- Corrugated, Trivisions, Neon signs, MMT signs, Hoardings, Billboards, Pole signs, Sky Signs, Name Boards, Notice Boards, Indicating boards, Banners, Streamers, moppy signs, LED , Posters, Skin, Leaflet, any type of advertisement a one way vision, Stickers, temporary publicity stalls, any vehicle including bus, truck, float, tractor, trolley, rehra, cart, tonga, cycle, auto rikshaw, taxi, car, jeep, boat or any other movable vehicle or through balloon / aeroplane etc.
  1. “ADVERTSMENT ON MOVING VEHICLES” any type of advertisement, which is made on moving vehicles such as bus, truck, tractor, trolley, floats, cycle, auto rickshaw, taxi, tonga, rhea, cart, boat or through air / aeroplane etc.
  2. “AUCTION” means to lease out outdoor advertisement of any nature through open competitive bidding after such period as may be prescribed by the Authority to ensure transparency and fairness.
  3. “AUTHORITY” means the Parks and Horticulture Authority, Faisalabad established under section 3 (2) of Parks & Horticulture Authority Act-2012
  • “BILL BOARD / HOARDING” includes an advertisement fixed, placed or displayed on a structure other than a building.
  • BUILDING ELEVATION” is a view of a building seen from one side, a flat representation of one facade.
  1. “CHAIRMAN” means the Chairman of the Authority.
  2. “COMMISSIONER” means the Commissioner of the Faisalabad Division appointed under the Punjab Land Revenue Act 1967.
  3. “COMMERCIAL BUILDING” means, a building having shops or show room, offices, hotels, restaurants, etc. on any floor and may also have apartments in it.
  • “COMPETENT AUTHORITY” means, the person or Committee so authorized by the Director General to take cognizance of matters covered in these Regulations.
  • “DIRCTOR GENERAL” means, the Director General of the Authority.
  • “DIRECTIONAL SIGN” any small hoarding fixed for the guidance of general public towards a   commercial or non-commercial entity
  1. “GOVERNMENT” means Government of the Punjab.
  • “KANAL” means a size of land equal to 20 marlas or 500 sq. yard        (418 m2).
  • “LED / LCD” means light emitting diode / liquid crystal display.

xviii.   “MARLA” means a size of land equal to 25 sq. yard or 225 sq. feet           (20.9 m2).

xix.     “MEMBER” means a member of authority and include its chairman.

  1. “MMT SIGNS” means any board made of MMT Sheet / Skin Sheet or     like material.

xxi. “MOPPY SIGN” means a small hoarding to be fixed on green belts,   central medians, near bus stops etc.

xxii “NAME BOARD” means, a board or any other substance used for the purpose of exhibiting the name of the firm or a business or individual or services.

  • “NEON SIGN” means any name board, notice board, indicating board or advertisement, illuminated by electricity or any other mean including an illuminated night sign.
  • “OFF SITE” means any notice board/hoarding/sky board which is installed by registered Architect/Company/ person to let it for advertisement purpose.
  • “ON SITE” means any notice board /hoarding/sky board which is installed for advertisement of its own business purposes of any company etc.
  • “OPERATIONAL AREA” means the four Urban Municipal Towns namely Lyallpur Town, Madina Town, Iqbal Town and Jinnah Town of the District of Faisalabad.
  • “OUTDOOR ADVERTISMENT” means a streamer, board, poster, banner , or any other thing placed, painted, pasted or installed on a public or private building or property so that it is visible from a public place and which is intended to inform the reader of the availability of a service, product or outlet or otherwise promote a person or a message.
  • “PERSON” include an individual, firm, cooperative society or association of individuals whether incorporated or not.
  • means prescribed by these regulations.
  • “POLE SIGN” means any name board, notice board or advertisement board installed / fixed on the electric pole, street light pole, only one approved sign is installed / fixed on the pole. The PHA reserves the right to use remaining portion of the pole for streamer / hanger and collect charges.
  • “POSTERS” any poster for the purpose of advertisement pasted or fixed or placed anywhere on building, wall, tree, any type of poles, fences or on any moving vehicle.
  • “REGISTERED ADVERTISERS” means, person, Multinational /National Companies qualified as such and enrolled on the list of approved advertisers maintained by the authority.
  • “RESIDENTIAL BUILDING” means, a building exclusively designed for use as a human habitation, together with such other houses as are ordinarily ancillary to the main building and used in connection therewith.
  • “SKY SIGN” means a sign installed on a building for its view from a distance.
  • “SKY LINE” means upper line of the building in the area.

 

  • “STREAMER” a vertical banner of wooden frame being fixed on street light poles for a weeks’ time.

 

  • “STRUCTURAL CALCULATIONS” means, detailed calculation showing sufficiency of the strength of every load bearing part of the proposed structure.
    • “STREET FURNITURE” means any structure installed by Government for the purpose other than advertisement that is public toilets, bus stops, bridge panels etc.

xxxix. “TERRITORIAL AREA” means the whole District of Faisalabad

  • “TRIVISION” means, a publicity illuminated/ non-illuminated board made of steel structure having three visions.

 

PART II

  1. APPLICATION OF PHA REGULATIONS

Every prospective advertiser including the Federal and Provincial Government, autonomous, semi autonomous and local bodies of Provincial and Federal Govt., Federal and Provincial Government agencies intending to carry, outdoor advertising within the limits of the operational area of the Authority shall comply with the “PHA REGULATIONS FOR OUTDOOR ADVERTISEMENT 2015” and shall not undertake any job of the kind in PHA’s operational area without prior approval as prescribed.

  1. REGULATION AND CONTROL OF ADVERTISEMENT

No Advertisement shall be erected, exhibited, fixed or retained upon or over and land, building , wall, hoardings, frame, post or structure or place within the operational area of Authority without prior written permission of the Competent Authority, granted in accordance with the provisions of these Regulations.

Provided that no permission shall be required for any onsite Advertisements,  having size less than 200 Sqft, which;

  1. Is exhibited on the glass with a transparent film within the window of any building if the advertisement relates to the trade, profession or business carried in that building provided it does not violate any building Bye-Laws , rules or regulations for the time being in force; or
    1.  Relates to name of the premises for building, trade, profession or business carried on, within the premises or building upon which such advertisement is exhibited; or .
  • Relates to any activity of the Federal, Provincial o any Local Government; or
  1. Is exhibited on an enclosed land and building not visible from outside the land or building.
  2. is a name plate announcing the name of owner or name of occupier of building and/or name of a building upon which such advisement is so fixed, exhibited painted, pasted, retained or displayed.
  3. in the case of residential buildings where commercial activity like nursing home, charted accountant, advocate, doctor, architect or any other professional is running, as permitted by law, and advertisement is allowed up to maximum as permitted under the provisions of respective law in force for the time being.
  4. REGISTRATION OF ADVERTISERS

(1)       Any person intending to erect, exhibit or fix any advertisement or to carry Advertisement job shall get himself registered on the panel of registered advertisers of the Authority, Faisalabad, by submitting an application to the Competent Authority on the prescribed form and on payment of registration fee of Rs. 30,000/- annually along with one time security fee of Rs 50,000/- under the provisions of these Regulations.

(2)        A practicing advertiser shall also get himself registered on the penal of advertisers of the Authority by submitting an application in prescribed form appended to these Regulations.

(3)      An Application referred to in sub-Clause (1) shall be accompanied by;

  1. Attested Copy of CNIC, in case of individual;
  2. Attested Copy of registration Certificate, in case of firm, corporation or Company;
  • NTN number;
  1. No default Certificate/Affidavit;
    1. Indemnity Bond

(4)   The Competent Authority reserves the right to approve or reject any such application subject to criteria at Annexure ( A ) and registration requires renewal in every financial year.

  1. APPLICATION FOR THE PERMISSION OF ADVERTISEMENT.

(1)    Any person intending to erect, exhibit, fix or retain any Advertisement, for which the prior written permission of Competent Authority is required, shall apply for such permission of the Competent Authority by filing an application on a prescribed form and on payment of such fee as may be prescribed from time to time under the provisions of these Regulations.

(2)        An Application referred to in sub-Clause (1) shall be accompanied by;

  1. Written request of landowner or the person legally authorized to accord such NOC.
  2. A full specification showing the dimensions of such sign, its location or proposed location on a building or other supporting structure, the materials of construction, design, and where applicable, the number of electric lights and electrical details in regard thereto;
  • In the case of Hoarding signs, information in regard to all calculations upon which such size is based;
  1. Any other details required by the Competent Authority; and
  2. The paid Original Bank Challan of prescribed NOC/Permission fee for each application before the approval of permission.

 

  1. PROCEDURE ON APPLICATION

       (1)     On receipt of an application under Clause-4, the Competent Authority shall refer it to the Director (Coordination & Marketing) for detailed scrutiny and submission of his recommendations.

(2)    The Director (Coordination & Marketing) while considering an application in terms of sub-Clause (1), must, in addition to any other relevant factor, legislation, policy and byelaws for the time being in force, shall have due regard to the following:

  1. The compatibility of the proposed advertising sign with the environment and with the amenity of the immediate neighborhood, urban design and streetscape;
  2. Whether the proposed advertising sign will;-

 

  1. Have a negative visual impact on any property zoned or used for residential purposes.
  2. Constitute a danger to any person or property or to motorists or pedestrians or obstruct vehicular or pedestrian traffic;
  3. In any way impair the visibility of any Road traffic sign;
  4. Obscure any existing and legally erected advertising sign;
  5. Obscure any feature which in his opinion is of a natural feature, architectural feature or visual line of civic, architectural, historical or heritage significance; or
  6. Be unsightly or objectionable or detrimentally impact on the architectural design of any building on the property concerned or any adjacent property;

 

  1. The number of advertising signs, displayed or to be displayed on the property concerned and on any adjacent property and its visibility in the circumstances in which it will be viewed in compliance with the minimum distances as prescribed.
  2. The area of control applicable to the property on which the proposed advertising sign is to be erected and the immediate surrounding area.
  • Any written representations, objections and comments received from any interested person. Director (C & M) shall decide the objections etc before proceeding with the case; and.
  1. Any conflict with provisions of these Regulations.

(3)          If, upon scrutiny of the application, the Director (Coordination and Marketing) requires any additional information with respect to the application or if the application is incomplete, the Director (C&M) shall inform the person in writing and such information shall be provided to him within a period of seven days from issuance of such notice.

(4)          If the Person fails to furnish the required information within the stipulated time, the application for permission shall stand rejected and fees submitted by him shall be fortified and the security fee may be refunded on his written request.

(5)      After submission of scrutiny report and recommendations by the Director (C & M), the Competent Authority, may grant permission, on such terms and conditions as it may determine, or refuse the application.

(6)    The holder of permission for Advertisement must ensure that, on every Advertisement for which the permission is granted, the unique number of the permission shall be displayed at prominent place.

(7)        The permission granted under sub-Clause 5 shall be valid only for a period of one year and on expiry of such period, every Person shall apply for its renewal and the Competent Authority may grant permission, on such terms and conditions as it may determine, or refuse an application for renewal with or without assigning any reason.

PART-III

8       TYPES OF ADVERTISEMENT AND CRITERIA

  1. Residential Buildings: Installation of advertisement and signboards in or on residential Buildings shall not be permitted except for onsite signage for purpose of   identification on buildings legally allowed for a purpose other than residential.
  2. Commercial/Industrial Areas/Building: The competent authority may allow advertisements and signboards in the commercial/industrial areas / buildings, however, advertisements and signboards on buildings and Roads shall be allowed only if in conformity with the prevailing building regulations and other act, ordinance, rules, regulations, By-Laws or notification issued to protect and preserve the environment, design and architecture or right of way in the area.

 

  • Onsite signage on the business premises shall be encouraged to be standardized and limited to create an ambient and pleasant environment.
  1. Along Roads Declared Commercial: Outdoor advertisement board and signs may be allowed on Roads which have been declared as commercial, but limited to static advertisements (where the frame, structure and message are stationary).
  2. Any kind of moving signs, LCDs or LEDs shall not be permitted along Roadsides .However these may be permitted at pedestrian areas, parking place and in parks and markets.

 

  1. Sky Sign
  2. a) Display of any sign on private, Govt. or any other property is permissible subject to the approval of the authority in accordance with PHA policy & specifications.
  3. b) Façade Sign /Wall Sign: The sky sign can be fixed on the façade of commercial building with the maximum size of 1200 Sft. The advertising structure must be contained completely within the solid boundaries of the building walls (i.e. the sign must not be wider or higher than the building itself). The advertisement must not extend over or block windows or other openings in the building.
  4. c) Roof Top Sky Sign: up to three storeys commercial building is allowed to install roof top sky sign. The board will be installed within parapet wall and maximum height will be 15 feet from roof level including structure. The building having more than three storeys is not allowed to install any type of sky sign on the roof top.

vii)             Bill Board: In case of Bill Board/ Sign Board on land, they should not exceed the height limit of 35 feet. However, along the elevated structure like over head bridge, height limit shall be measured from the top level of the road at the bridge.

PART- IV

                   SIZE, SPACING, STRUCTURE AND SAFETY OF ADVERTISEMENTS

  1. SIZE. – The size of on-site and off-site Advertisements and signboards shall be standardized and notified by the Competent Authority, while considering the special characteristics of each place, market, roads or premises. However, the maximum size of any Bill board shall not exceed  60’ X 20’ in cities and will not exceed  90’ X 30’ on highways and intercity roads.
  2. SPACING. – The minimum spacing between two Advertisements should not be less than 150 feet for bill Boards, hoarding boards or free standing Boards on ground within city and not be less than 200’ on intercity Roads and highways. Only one wall sign /façade sign shall be allowed per building elevation.
  3. STRUCTURE. – Every Person having due permission of Competent Authority to retain, erect, exhibit or fix the Advertisements in any area shall ensure that the Advertisement is aesthetically pleasing and blending with the surrounding architecture, design and environment of the area.
  4. SAFETY.- Every person erecting, exhibiting, fixing or retaining any Advertisement, for which the prior written permission of Competent Authority has been given, shall develop an adequate control and system to ensure;
  5. No advertisement or sign boards, cutouts on temporary basis shall be installed inside central medians, roundabouts and triangles except direction board, moppy signs and publicity material like streamers and pole signs to be fixed on street furniture or poles.
  6. Sign boards site will not be given/renewed to an advertiser, Multinational /National companies who is either defaulter or blacklisted or is in habit of litigation with PHA.
  7. The publicity board will not hinder the view of the drivers for safe driving and is not a hurdle in the free flow of traffic.
  8. Minimum clearance between Road level and the lower edge of the signboard shall be 12 feet ( in case of 20’*60’), 10 feet ( in case of 15’*45’) and 7 feet ( in case of 10’*20’ or 10’*30’).
  9. The installation of Advertising Substance in or on monument building, grave yard, mosque, shrine, churches or other place of worship, or a Govt. building or a place of national importance shall not be allowed.
  10. No cross Road banner will be allowed.
  11. All outdoor advertisement and sign boards shall be fabricated in a structurally safe manner and shall be installed or retained in a manner which doesn’t adversely affect the road safety or integrity of the building structure on which they are fixed. The advertising company / sole proprietor shall be bound to adhere to the instruction / guidelines issued by the Govt. or Authority.
  12. The commercial advertisement must not be placed on heritage buildings, items excluding Railway Station.
  13. No advertisement or sign board shall be affixed to traffic signal or directional board poles.
  14. No advertisement or sign board shall use imitation, images or colors of traffic signals, traffic signs or directional indicators anywhere in the vicinity of road junctions and traffic signals.
  15. Pole sign on street light pole shall be only allowed in accordance with the designed structural stability.
  16. SCRIPT OF ADVERTISEMENT. (1) Every person having due permission of Competent Authority under Clause 9 (5) to erect, exhibit or fix the Advertisements in any area shall ensure that the Advertisement should not be contrary to social norms, public morality and public decency or against the state or any religion or creating ethnic or sectarian conflict considered misleading to the general public.

(2) On receiving such complaints the Competent Authority shall notify a committee, including members from academia and civil society to act as a review forum for addressing public complaints against such offensive matter.

  1. Alterations of and additions to Advertisements:-

(1)    Any person wishing to alter or add to any Advertisement, including any sign board on which it is displayed, shall first apply to the Competent Authority in writing for its approval.

(2)    Any application referred to in sub clause (1) shall in addition to the requirements of these Regulations specify the nature and extent of the proposed alteration or addition.

(3)    Any person intending to apply under sub-Clause (2) for the approval of Competent Authority, shall furnish such additional particulars in connection with his application as the Competent Authority may require.

PART-V

  1. INSPECTION / EXAMINATION/PENALTIES.

The authority may through its authorized officers at any time, before approval of application received and during execution of work, before and after receipt of completion notice and from time to time inspect the installation.

If on making any inspection under the Regulations authority finds that the advertisement substance contravenes any of provisions of these Regulations, the officer duly authorized by the authority shall by written notice require the person (owner) within a period to be specified in such notice, to make such alteration as shall be specified in such notice with the object of bringing advertisement substance in conformity with the approval, specification and policy of PHA.

In the event of default, without further notice the billboard, hoarding, neon sign etc shall be uprooted at the cost & risk of advertiser and the debris and any fees deposited shall be confiscated and fine of Rs.20,000/- may be impsed. More than three instances of violation by an advertiser shall warrant black listing of the advertiser.

  1. 16. APPEAL

Any person aggrieved by an order passed under these Regulations may file an appeal to the Commissioner, Faisalabad within 30 days of the receipt of order.

Any person aggrieved by an order passed by the appellate authority/Commissioner may file an appeal to the Secretary, HUD & PHE. Dept within 60 days of the receipt of order. The decision of the Secretary, HUD & PHE Deptt. shall be final.

  1. SPECIAL POWER
  2. The D.G. may at any time for reason to be recorded in writing direct the removal of any bill board, sign board etc. if in his opinion such bill board, or notice board etc is indecent, obscene or offensive to good taste or space or site is required for other purpose by PHA, Govt. or for public interest.
  3. The Authority may at any time withdraw any of it approval without assigning any reason. However the aggrieved   persons will be paid the balance of lease money proportionately.
  4. The D.G. on behalf of Authority shall use all the powers provided in the PHA ACT 2012.
  5. Maintenance of Advertisements.-
  6. I) The person having possession and control of any Advertisement shall, while such Advertisement is displayed at all times maintain such advertisement, including any signboard on which it is displayed in good repair and safe conditions.
  7. INDEMNITY.
  8. Any person duly authorized to erect, exhibit or install and Advertisement shall indemnify against any loss to life or property arising out of the incident due to collapse of advertisement board/sign to the extent :-

Compensation                                                 As per site assessment by the credible and practicing Civil Engineer, registered with Pakistan Engineering Council.

  1. AUCTION OF ADVERTISEMENT SITES.
  2. i) All sites for installation of hoarding signs/bill boards (other than moppy signs, directional boards, streamers, banners and floats) on parks /green areas/belts shall be awarded through open auction for a period of three years, extendable for two years in discretion of Director General, in order to gain maximum revenue for the Authority.
  3. ii) The D.G PHA may allow the Multinational or National Companies or both to participate in the auction.

 

 

 

 

  1. Advertisement Fee.
  2. i) The PHA Faisalabad shall in each financial year notify the Advertisement Fee for a fiscal year. The Advertisement Fee may vary from area to area (appended as Annexure ( B ).
  3. ii) The detail of categories of A+, A, B and C Roads and Chowks is appended at Annexure ( C )

iii)        The Board of Directors of PHA may re-categorize any road or chowk at any time.

  1. The Board of Directors of PHA reserves the right to enhance, reduce or change the rates /fee in the public interest.
  2. Collection of the amount of charges/fee shall be made at the Head Office i.e. Coordination and Marketing Directorate of Authority in such manner as the Competent Authority may determine.
    1. The D.G. may in his discretion allow the publicity free of cost, which is purely of a charitable nature or is to be advertised in public interest.

 

  • Provided if required collection of the charges/fees of all items at Annexure (B) shall be made through contractor by awarding collection rights to him for a period not exceeding one financial year and contract of collection rights of charges/fees shall be awarded to contractor in the manner prescribed in Punjab Local Government (Auctioning of Collection Rights) Rules, 2003 mutatis mutandis .

 

  • A Reserve Price Committee will be constituted by the Director General for assessment of reserve price of items collection of which is to be made through contractor.

                 NOTIFICATION

 

 

PHA, FAISALABAD REGULATIONS FOR OUTDOOR ADVERTISEMENT, 2015.

In exercise of the powers conferred under section 31 of The Parks and Horticulture Authority Act XLVII OF 2012, the Board of Directors of Parks and Horticulture Authority Faisalabad is pleased to frame its regulations for Outdoor Advertisement.

 

  1. SHORT TITLE, EXTENT AND COMMENCEMENT.

 

  1. These regulations may be cited as PHA Faisalabad Regulations for Outdoor advertisement, 2015.

 

  1. These regulations shall extend to the operational area of the Parks and Horticulture Authority, Faisalabad.

 

  • These regulations shall come into force with effect from 01.07.2015. However, these regulations shall come into force with immediate effect to the extent of new registration of advertisers and issuance of new NOC for installation of boards etc.

 

PART- 1

  1. DEFINITIONS

 

Unless otherwise expressly stated, the following terms shall, for the purpose of these Regulations have the meanings indicated in this part. Where the terms are not defined they shall have their ordinarily accepted meaning or such as the context may apply.

  1. “ACT” means The Parks and Horticulture Authority Act 2012.
  2. “ADVERTISEMENT” means commercially displayed or installed signage, board, screen, streamer, poster, banner or any other thing placed, painted, pasted or installed on public or private property that is visible from a public place and is intended to inform the reader of the availability of a service, product or promotes a business.
  • “ADVERTISING SUBSTANCE” means, any one or more of the following :- Corrugated, Trivisions, Neon signs, MMT signs, Hoardings, Billboards, Pole signs, Sky Signs, Name Boards, Notice Boards, Indicating boards, Banners, Streamers, moppy signs, LED , Posters, Skin, Leaflet, any type of advertisement a one way vision, Stickers, temporary publicity stalls, any vehicle including bus, truck, float, tractor, trolley, rehra, cart, tonga, cycle, auto rikshaw, taxi, car, jeep, boat or any other movable vehicle or through balloon / aeroplane etc.
  1. “ADVERTSMENT ON MOVING VEHICLES” any type of advertisement, which is made on moving vehicles such as bus, truck, tractor, trolley, floats, cycle, auto rickshaw, taxi, tonga, rhea, cart, boat or through air / aeroplane etc.
  2. “AUCTION” means to lease out outdoor advertisement of any nature through open competitive bidding after such period as may be prescribed by the Authority to ensure transparency and fairness.
  3. “AUTHORITY” means the Parks and Horticulture Authority, Faisalabad established under section 3 (2) of Parks & Horticulture Authority Act-2012
  • “BILL BOARD / HOARDING” includes an advertisement fixed, placed or displayed on a structure other than a building.
  • BUILDING ELEVATION” is a view of a building seen from one side, a flat representation of one facade.
  1. “CHAIRMAN” means the Chairman of the Authority.
  2. “COMMISSIONER” means the Commissioner of the Faisalabad Division appointed under the Punjab Land Revenue Act 1967.
  3. “COMMERCIAL BUILDING” means, a building having shops or show room, offices, hotels, restaurants, etc. on any floor and may also have apartments in it.
  • “COMPETENT AUTHORITY” means, the person or Committee so authorized by the Director General to take cognizance of matters covered in these Regulations.
  • “DIRCTOR GENERAL” means, the Director General of the Authority.
  • “DIRECTIONAL SIGN” any small hoarding fixed for the guidance of general public towards a   commercial or non-commercial entity
  1. “GOVERNMENT” means Government of the Punjab.
  • “KANAL” means a size of land equal to 20 marlas or 500 sq. yard        (418 m2).
  • “LED / LCD” means light emitting diode / liquid crystal display.

xviii.   “MARLA” means a size of land equal to 25 sq. yard or 225 sq. feet           (20.9 m2).

xix.     “MEMBER” means a member of authority and include its chairman.

  1. “MMT SIGNS” means any board made of MMT Sheet / Skin Sheet or     like material.

xxi. “MOPPY SIGN” means a small hoarding to be fixed on green belts,   central medians, near bus stops etc.

xxii “NAME BOARD” means, a board or any other substance used for the purpose of exhibiting the name of the firm or a business or individual or services.

  • “NEON SIGN” means any name board, notice board, indicating board or advertisement, illuminated by electricity or any other mean including an illuminated night sign.
  • “OFF SITE” means any notice board/hoarding/sky board which is installed by registered Architect/Company/ person to let it for advertisement purpose.
  • “ON SITE” means any notice board /hoarding/sky board which is installed for advertisement of its own business purposes of any company etc.
  • “OPERATIONAL AREA” means the four Urban Municipal Towns namely Lyallpur Town, Madina Town, Iqbal Town and Jinnah Town of the District of Faisalabad.
  • “OUTDOOR ADVERTISMENT” means a streamer, board, poster, banner , or any other thing placed, painted, pasted or installed on a public or private building or property so that it is visible from a public place and which is intended to inform the reader of the availability of a service, product or outlet or otherwise promote a person or a message.
  • “PERSON” include an individual, firm, cooperative society or association of individuals whether incorporated or not.
  • means prescribed by these regulations.
  • “POLE SIGN” means any name board, notice board or advertisement board installed / fixed on the electric pole, street light pole, only one approved sign is installed / fixed on the pole. The PHA reserves the right to use remaining portion of the pole for streamer / hanger and collect charges.
  • “POSTERS” any poster for the purpose of advertisement pasted or fixed or placed anywhere on building, wall, tree, any type of poles, fences or on any moving vehicle.
  • “REGISTERED ADVERTISERS” means, person, Multinational /National Companies qualified as such and enrolled on the list of approved advertisers maintained by the authority.
  • “RESIDENTIAL BUILDING” means, a building exclusively designed for use as a human habitation, together with such other houses as are ordinarily ancillary to the main building and used in connection therewith.
  • “SKY SIGN” means a sign installed on a building for its view from a distance.
  • “SKY LINE” means upper line of the building in the area.

 

  • “STREAMER” a vertical banner of wooden frame being fixed on street light poles for a weeks’ time.

 

  • “STRUCTURAL CALCULATIONS” means, detailed calculation showing sufficiency of the strength of every load bearing part of the proposed structure.
    • “STREET FURNITURE” means any structure installed by Government for the purpose other than advertisement that is public toilets, bus stops, bridge panels etc.

xxxix. “TERRITORIAL AREA” means the whole District of Faisalabad

  • “TRIVISION” means, a publicity illuminated/ non-illuminated board made of steel structure having three visions.

 

PART II

  1. APPLICATION OF PHA REGULATIONS

Every prospective advertiser including the Federal and Provincial Government, autonomous, semi autonomous and local bodies of Provincial and Federal Govt., Federal and Provincial Government agencies intending to carry, outdoor advertising within the limits of the operational area of the Authority shall comply with the “PHA REGULATIONS FOR OUTDOOR ADVERTISEMENT 2015” and shall not undertake any job of the kind in PHA’s operational area without prior approval as prescribed.

  1. REGULATION AND CONTROL OF ADVERTISEMENT

No Advertisement shall be erected, exhibited, fixed or retained upon or over and land, building , wall, hoardings, frame, post or structure or place within the operational area of Authority without prior written permission of the Competent Authority, granted in accordance with the provisions of these Regulations.

Provided that no permission shall be required for any onsite Advertisements,  having size less than 200 Sqft, which;

  1. Is exhibited on the glass with a transparent film within the window of any building if the advertisement relates to the trade, profession or business carried in that building provided it does not violate any building Bye-Laws , rules or regulations for the time being in force; or
    1.  Relates to name of the premises for building, trade, profession or business carried on, within the premises or building upon which such advertisement is exhibited; or .
  • Relates to any activity of the Federal, Provincial o any Local Government; or
  1. Is exhibited on an enclosed land and building not visible from outside the land or building.
  2. is a name plate announcing the name of owner or name of occupier of building and/or name of a building upon which such advisement is so fixed, exhibited painted, pasted, retained or displayed.
  3. in the case of residential buildings where commercial activity like nursing home, charted accountant, advocate, doctor, architect or any other professional is running, as permitted by law, and advertisement is allowed up to maximum as permitted under the provisions of respective law in force for the time being.
  4. REGISTRATION OF ADVERTISERS

(1)       Any person intending to erect, exhibit or fix any advertisement or to carry Advertisement job shall get himself registered on the panel of registered advertisers of the Authority, Faisalabad, by submitting an application to the Competent Authority on the prescribed form and on payment of registration fee of Rs. 30,000/- annually along with one time security fee of Rs 50,000/- under the provisions of these Regulations.

(2)        A practicing advertiser shall also get himself registered on the penal of advertisers of the Authority by submitting an application in prescribed form appended to these Regulations.

(3)      An Application referred to in sub-Clause (1) shall be accompanied by;

  1. Attested Copy of CNIC, in case of individual;
  2. Attested Copy of registration Certificate, in case of firm, corporation or Company;
  • NTN number;
  1. No default Certificate/Affidavit;
    1. Indemnity Bond

(4)   The Competent Authority reserves the right to approve or reject any such application subject to criteria at Annexure ( A ) and registration requires renewal in every financial year.

  1. APPLICATION FOR THE PERMISSION OF ADVERTISEMENT.

(1)    Any person intending to erect, exhibit, fix or retain any Advertisement, for which the prior written permission of Competent Authority is required, shall apply for such permission of the Competent Authority by filing an application on a prescribed form and on payment of such fee as may be prescribed from time to time under the provisions of these Regulations.

(2)        An Application referred to in sub-Clause (1) shall be accompanied by;

  1. Written request of landowner or the person legally authorized to accord such NOC.
  2. A full specification showing the dimensions of such sign, its location or proposed location on a building or other supporting structure, the materials of construction, design, and where applicable, the number of electric lights and electrical details in regard thereto;
  • In the case of Hoarding signs, information in regard to all calculations upon which such size is based;
  1. Any other details required by the Competent Authority; and
  2. The paid Original Bank Challan of prescribed NOC/Permission fee for each application before the approval of permission.

 

  1. PROCEDURE ON APPLICATION

       (1)     On receipt of an application under Clause-4, the Competent Authority shall refer it to the Director (Coordination & Marketing) for detailed scrutiny and submission of his recommendations.

(2)    The Director (Coordination & Marketing) while considering an application in terms of sub-Clause (1), must, in addition to any other relevant factor, legislation, policy and byelaws for the time being in force, shall have due regard to the following:

  1. The compatibility of the proposed advertising sign with the environment and with the amenity of the immediate neighborhood, urban design and streetscape;
  2. Whether the proposed advertising sign will;-

 

  1. Have a negative visual impact on any property zoned or used for residential purposes.
  2. Constitute a danger to any person or property or to motorists or pedestrians or obstruct vehicular or pedestrian traffic;
  3. In any way impair the visibility of any Road traffic sign;
  4. Obscure any existing and legally erected advertising sign;
  5. Obscure any feature which in his opinion is of a natural feature, architectural feature or visual line of civic, architectural, historical or heritage significance; or
  6. Be unsightly or objectionable or detrimentally impact on the architectural design of any building on the property concerned or any adjacent property;

 

  1. The number of advertising signs, displayed or to be displayed on the property concerned and on any adjacent property and its visibility in the circumstances in which it will be viewed in compliance with the minimum distances as prescribed.
  2. The area of control applicable to the property on which the proposed advertising sign is to be erected and the immediate surrounding area.
  • Any written representations, objections and comments received from any interested person. Director (C & M) shall decide the objections etc before proceeding with the case; and.
  1. Any conflict with provisions of these Regulations.

(3)          If, upon scrutiny of the application, the Director (Coordination and Marketing) requires any additional information with respect to the application or if the application is incomplete, the Director (C&M) shall inform the person in writing and such information shall be provided to him within a period of seven days from issuance of such notice.

(4)          If the Person fails to furnish the required information within the stipulated time, the application for permission shall stand rejected and fees submitted by him shall be fortified and the security fee may be refunded on his written request.

(5)      After submission of scrutiny report and recommendations by the Director (C & M), the Competent Authority, may grant permission, on such terms and conditions as it may determine, or refuse the application.

(6)    The holder of permission for Advertisement must ensure that, on every Advertisement for which the permission is granted, the unique number of the permission shall be displayed at prominent place.

(7)        The permission granted under sub-Clause 5 shall be valid only for a period of one year and on expiry of such period, every Person shall apply for its renewal and the Competent Authority may grant permission, on such terms and conditions as it may determine, or refuse an application for renewal with or without assigning any reason.

PART-III

8       TYPES OF ADVERTISEMENT AND CRITERIA

  1. Residential Buildings: Installation of advertisement and signboards in or on residential Buildings shall not be permitted except for onsite signage for purpose of   identification on buildings legally allowed for a purpose other than residential.
  2. Commercial/Industrial Areas/Building: The competent authority may allow advertisements and signboards in the commercial/industrial areas / buildings, however, advertisements and signboards on buildings and Roads shall be allowed only if in conformity with the prevailing building regulations and other act, ordinance, rules, regulations, By-Laws or notification issued to protect and preserve the environment, design and architecture or right of way in the area.

 

  • Onsite signage on the business premises shall be encouraged to be standardized and limited to create an ambient and pleasant environment.
  1. Along Roads Declared Commercial: Outdoor advertisement board and signs may be allowed on Roads which have been declared as commercial, but limited to static advertisements (where the frame, structure and message are stationary).
  2. Any kind of moving signs, LCDs or LEDs shall not be permitted along Roadsides .However these may be permitted at pedestrian areas, parking place and in parks and markets.

 

  1. Sky Sign
  2. a) Display of any sign on private, Govt. or any other property is permissible subject to the approval of the authority in accordance with PHA policy & specifications.
  3. b) Façade Sign /Wall Sign: The sky sign can be fixed on the façade of commercial building with the maximum size of 1200 Sft. The advertising structure must be contained completely within the solid boundaries of the building walls (i.e. the sign must not be wider or higher than the building itself). The advertisement must not extend over or block windows or other openings in the building.
  4. c) Roof Top Sky Sign: up to three storeys commercial building is allowed to install roof top sky sign. The board will be installed within parapet wall and maximum height will be 15 feet from roof level including structure. The building having more than three storeys is not allowed to install any type of sky sign on the roof top.

vii)             Bill Board: In case of Bill Board/ Sign Board on land, they should not exceed the height limit of 35 feet. However, along the elevated structure like over head bridge, height limit shall be measured from the top level of the road at the bridge.

PART- IV

                   SIZE, SPACING, STRUCTURE AND SAFETY OF ADVERTISEMENTS

  1. SIZE. – The size of on-site and off-site Advertisements and signboards shall be standardized and notified by the Competent Authority, while considering the special characteristics of each place, market, roads or premises. However, the maximum size of any Bill board shall not exceed  60’ X 20’ in cities and will not exceed  90’ X 30’ on highways and intercity roads.
  2. SPACING. – The minimum spacing between two Advertisements should not be less than 150 feet for bill Boards, hoarding boards or free standing Boards on ground within city and not be less than 200’ on intercity Roads and highways. Only one wall sign /façade sign shall be allowed per building elevation.
  3. STRUCTURE. – Every Person having due permission of Competent Authority to retain, erect, exhibit or fix the Advertisements in any area shall ensure that the Advertisement is aesthetically pleasing and blending with the surrounding architecture, design and environment of the area.
  4. SAFETY.- Every person erecting, exhibiting, fixing or retaining any Advertisement, for which the prior written permission of Competent Authority has been given, shall develop an adequate control and system to ensure;
  5. No advertisement or sign boards, cutouts on temporary basis shall be installed inside central medians, roundabouts and triangles except direction board, moppy signs and publicity material like streamers and pole signs to be fixed on street furniture or poles.
  6. Sign boards site will not be given/renewed to an advertiser, Multinational /National companies who is either defaulter or blacklisted or is in habit of litigation with PHA.
  7. The publicity board will not hinder the view of the drivers for safe driving and is not a hurdle in the free flow of traffic.
  8. Minimum clearance between Road level and the lower edge of the signboard shall be 12 feet ( in case of 20’*60’), 10 feet ( in case of 15’*45’) and 7 feet ( in case of 10’*20’ or 10’*30’).
  9. The installation of Advertising Substance in or on monument building, grave yard, mosque, shrine, churches or other place of worship, or a Govt. building or a place of national importance shall not be allowed.
  10. No cross Road banner will be allowed.
  11. All outdoor advertisement and sign boards shall be fabricated in a structurally safe manner and shall be installed or retained in a manner which doesn’t adversely affect the road safety or integrity of the building structure on which they are fixed. The advertising company / sole proprietor shall be bound to adhere to the instruction / guidelines issued by the Govt. or Authority.
  12. The commercial advertisement must not be placed on heritage buildings, items excluding Railway Station.
  13. No advertisement or sign board shall be affixed to traffic signal or directional board poles.
  14. No advertisement or sign board shall use imitation, images or colors of traffic signals, traffic signs or directional indicators anywhere in the vicinity of road junctions and traffic signals.
  15. Pole sign on street light pole shall be only allowed in accordance with the designed structural stability.
  16. SCRIPT OF ADVERTISEMENT. (1) Every person having due permission of Competent Authority under Clause 9 (5) to erect, exhibit or fix the Advertisements in any area shall ensure that the Advertisement should not be contrary to social norms, public morality and public decency or against the state or any religion or creating ethnic or sectarian conflict considered misleading to the general public.

(2) On receiving such complaints the Competent Authority shall notify a committee, including members from academia and civil society to act as a review forum for addressing public complaints against such offensive matter.

  1. Alterations of and additions to Advertisements:-

(1)    Any person wishing to alter or add to any Advertisement, including any sign board on which it is displayed, shall first apply to the Competent Authority in writing for its approval.

(2)    Any application referred to in sub clause (1) shall in addition to the requirements of these Regulations specify the nature and extent of the proposed alteration or addition.

(3)    Any person intending to apply under sub-Clause (2) for the approval of Competent Authority, shall furnish such additional particulars in connection with his application as the Competent Authority may require.

PART-V

  1. INSPECTION / EXAMINATION/PENALTIES.

The authority may through its authorized officers at any time, before approval of application received and during execution of work, before and after receipt of completion notice and from time to time inspect the installation.

If on making any inspection under the Regulations authority finds that the advertisement substance contravenes any of provisions of these Regulations, the officer duly authorized by the authority shall by written notice require the person (owner) within a period to be specified in such notice, to make such alteration as shall be specified in such notice with the object of bringing advertisement substance in conformity with the approval, specification and policy of PHA.

In the event of default, without further notice the billboard, hoarding, neon sign etc shall be uprooted at the cost & risk of advertiser and the debris and any fees deposited shall be confiscated and fine of Rs.20,000/- may be impsed. More than three instances of violation by an advertiser shall warrant black listing of the advertiser.

  1. 16. APPEAL

Any person aggrieved by an order passed under these Regulations may file an appeal to the Commissioner, Faisalabad within 30 days of the receipt of order.

Any person aggrieved by an order passed by the appellate authority/Commissioner may file an appeal to the Secretary, HUD & PHE. Dept within 60 days of the receipt of order. The decision of the Secretary, HUD & PHE Deptt. shall be final.

  1. SPECIAL POWER
  2. The D.G. may at any time for reason to be recorded in writing direct the removal of any bill board, sign board etc. if in his opinion such bill board, or notice board etc is indecent, obscene or offensive to good taste or space or site is required for other purpose by PHA, Govt. or for public interest.
  3. The Authority may at any time withdraw any of it approval without assigning any reason. However the aggrieved   persons will be paid the balance of lease money proportionately.
  4. The D.G. on behalf of Authority shall use all the powers provided in the PHA ACT 2012.
  5. Maintenance of Advertisements.-
  6. I) The person having possession and control of any Advertisement shall, while such Advertisement is displayed at all times maintain such advertisement, including any signboard on which it is displayed in good repair and safe conditions.
  7. INDEMNITY.
  8. Any person duly authorized to erect, exhibit or install and Advertisement shall indemnify against any loss to life or property arising out of the incident due to collapse of advertisement board/sign to the extent :-

 

In case of death                                              Rs.5 Hundred Thousands

 

In case of Injury                                              Rs.50 Thousands

 

In case of loss to property Rupees/

Compensation                                                 As per site assessment by the credible and practicing Civil Engineer, registered with Pakistan Engineering Council.

  1. AUCTION OF ADVERTISEMENT SITES.
  2. i) All sites for installation of hoarding signs/bill boards (other than moppy signs, directional boards, streamers, banners and floats) on parks /green areas/belts shall be awarded through open auction for a period of three years, extendable for two years in discretion of Director General, in order to gain maximum revenue for the Authority.
  3. ii) The D.G PHA may allow the Multinational or National Companies or both to participate in the auction.

 

 

 

 

  1. Advertisement Fee.
  2. i) The PHA Faisalabad shall in each financial year notify the Advertisement Fee for a fiscal year. The Advertisement Fee may vary from area to area (appended as Annexure ( B ).
  3. ii) The detail of categories of A+, A, B and C Roads and Chowks is appended at Annexure ( C )

iii)        The Board of Directors of PHA may re-categorize any road or chowk at any time.

  1. The Board of Directors of PHA reserves the right to enhance, reduce or change the rates /fee in the public interest.
  2. Collection of the amount of charges/fee shall be made at the Head Office i.e. Coordination and Marketing Directorate of Authority in such manner as the Competent Authority may determine.
    1. The D.G. may in his discretion allow the publicity free of cost, which is purely of a charitable nature or is to be advertised in public interest.

 

  • Provided if required collection of the charges/fees of all items at Annexure (B) shall be made through contractor by awarding collection rights to him for a period not exceeding one financial year and contract of collection rights of charges/fees shall be awarded to contractor in the manner prescribed in Punjab Local Government (Auctioning of Collection Rights) Rules, 2003 mutatis mutandis .

 

  • A Reserve Price Committee will be constituted by the Director General for assessment of reserve price of items collection of which is to be made through contractor.
